Regeringspartij VVD stemt tegen het wetsvoorstel van het kabinet om de toegang van werknemers tot een bedrijfsarts te versterken. Dat kondigde VVD-Kamerlid Anoushka Schut-Welkzijn woensdagmiddag aan in een debat in de Tweede Kamer.
De VVD wil niet dat er een verplichting komt voor bedrijven om een zogeheten ‘basiscontract’ met een arbodienstverlener af te sluiten. De invoering van zo’n contract, dat een aantal minimumeisen bevat, leidt volgens Schut-Welkzijn tot louter administratieve rompslomp en hoge kosten voor werkgevers, en niet tot betere zorg.
Ziektepreventie
Het basiscontract is de kern van het kabinetsvoorstel om de arbeidsgeneeskundige zorg te verbeteren, meent verantwoordelijk minister Lodewijk Asscher van Sociale Zaken (PvdA). In het contract staat bijvoorbeeld dat iedere werknemer voortaan het recht krijgt om de bedrijfsarts te spreken, zonder dat de werkgever hierover wordt geïnformeerd of vooraf toestemming moet geven. Het achterliggende idee is dat werknemers zo al de arbo-arts kunnen raadplegen, voordat hun klachten uitmonden in het ziekteverzuim. De arts kan op die manier zich beter op ziektepreventie richten.
Andere minimumeisen in het contract zijn onder meer dat de bedrijfsarts krijgt om de werkplek te bezoeken en om met de ondernemingsraad te overleggen, zodat hij meer betrokken wordt bij het bedrijfsbeleid voor veilig en gezond werken. Daarnaast krijgt de werknemer, als het aan het kabinet ligt, het wettelijk recht om een second opinion van een andere bedrijfsarts te vragen. Een bedrijf moet straks ook een klachtenprocedure hebben voor als de werknemer ontevreden is over de bedrijfsarts. Tegen al deze voorstellen is de VVD fel gekant.
Kamermeerderheid
Het wetsvoorstel lijkt desondanks op een meerderheid te kunnen rekenen, omdat het in ieder geval in de ogen van PvdA, SP, CDA en D66 een verbetering is ten opzichte van de huidige situatie. Er leven nu grote zorgen over de onafhankelijkheid van de bedrijfsarts, die door de werkgever wordt betaald. De arts zou te veel zijn oren naar het bedrijf laten hangen. Ook zou hij, bijvoorbeeld uit angst zijn contract te verliezen, beroepsziekten niet melden. Bijna de helft van de bedrijfsartsen heeft nog nooit een beroepsziekte gemeld, waardoor de kennis in Nederland hierover achterblijft ten opzichte van de ons omringende landen. Het melden van een beroepsziekte als RSI heeft er in het verleden toe geleid dat computermuizen lichter en makkelijker hanteerbaar werden en het verzuim is afgenomen.
Asscher komt daarom ook met een wettelijke meldingsplicht voor bedrijfsartsen in die basiscontracten. Hij hoopt dat daardoor het aantal meldingen flink toeneemt. Gebeurt dit niet, dan volgt in 2020 een evaluatie en wordt er wellicht een boetesysteem voor arbo-artsen geïntroduceerd. Om de artsen tegemoet te komen, worden de uren die zij steken in het herkennen en diagnosticeren van beroepsziekten wel declarabel. Dit is nu niet het geval, wat de artsen er mogelijk ook van weerhoudt de ziekten te melden.
Duizenden doden
Volgens het Nederlands Centrum voor beroepsziekten sterven ieder jaar ruim drieduizend Nederlanders, als gevolg van een beroepsziekte als asbestkanker of stoflongen.
