Het steunpunt voor teruggekeerde Marokkaanse migranten in Berkane in Marokko is blij dat een Nederlandse rechter voor de tweede keer de verlaging van de kinderbijslag heeft afgewezen. Vrijdag besliste de Centrale Raad van Beroep in Utrecht dat een lagere kinderbijslag voor kinderen in Marokko strijdig is met het sociale zekerheidsverdrag tussen Nederland en Marokko.
In januari noemde de Amsterdamse rechtbank de verlaging van de kinderbijslag ook al in strijd met het verdrag. De rechter bepaalde toen dat de Sociale Verzekeringsbank (SVB) de uitkeringen aan teruggekeerde Marokkanen niet met 40 procent had mogen verlagen in het kader van de Wet woonlandbeginsel.
Reële kosten
De Wet woonlandbeginsel, die op 1 juli 2012 werd aangenomen, bepaalt dat uitkeringen moeten worden aangepast aan het niveau van de kosten van het levensonderhoud in het land waar de uitkeringsgerechtigde woont.
Uitkeringsgerechtigden vinden dat in strijd met het sociale zekerheidsverdrag tussen Nederland en Marokko, waarin uitkeringen worden beschermd. Omdat Marokko niet wil meewerken aan het verlagen van de uitkeringen heeft het Nederlandse kabinet inmiddels een wetsvoorstel ingediend om dat verdrag met Marokko op te zeggen.
Overleg nodig
Mohamed Sayem, directeur van de stichting Steunpunt Remigranten, is tevreden over de uitspraak, maar realiseert zich ook dat de strijd nog niet gestreden is. Als het verdrag wordt opgezegd, wordt de kinderbijslag naar Marokko volledig gestopt. Sayem hoopt dat constructief overleg bijdraagt aan een oplossing die beide partijen tevreden stemt. “De belangen zijn voor beide partijen te groot om verder overleg te staken.”
Marokko reageerde furieus op de voorgenomen opzegging van het verdrag. Minister Mezouar van Buitenlandse Zaken dreigde met gevolgen voor de samenwerking met Nederland op onder andere juridisch gebied. Vorige maand trok Marokko op het laatste moment een subsidie van een miljoen euro voor het Tropenmuseum in Amsterdam in.
De bezwaren van Turkije en Egypte tegen de verlaging van kinderbijslag werden in dezelfde zaak afgewezen, omdat deze landen geen sociale zekerheidsverdrag hebben met Nederland.
