Deelt u de mening dat de WNT niet van toepassing is op vrije beroepsbeoefenaren?

Is het CIBG (een uitvoeringsorganisatie van het ministerie van VWS; de letters CIBG stonden oorspronkelijk voor Centraal Informatiepunt Beroepen Gezondheidszorg, maar die betekenis is niet meer ladingdekkend) opgedragen een toelating tot de Wet Toelating Zorginstellingen (WTZi) als criterium te gebruiken, om te bepalen wie van de vrije beroepsbeoefenaren onder de WNT valt? Zo ja, waarom? Zo nee, waarom hebben ze het dan gedaan?

Deelt u de mening dat de WTZi ooit is bedoeld om te bepalen welke instelling wel of niet zorg mocht verlenen en dat het gebruik van deze toelating om te bepalen welke vrije beroepsbeoefenaar onder de WNT valt, buiten de reikwijdte van de WTZi valt? Zo nee, wat is uw reactie op het commentaar van de advocaten in het SKIPR artikel? Zo ja, wilt u met het CIBG in gesprek gaan over het ten onrechte gebruiken van de WTZi als selectiecriterium?

In bijlage 1 van de WNT staat dat de op grond van artikel 5 van de Wet toelating zorginstellingen toegelaten instellingen (Wtzi) onder de WNT vallen. Dat toegelaten instellingen op grond van de Wtzi onder de WNT vallen, volgt dus rechtstreeks uit de WNT. Het CIBG is toezichthouder op de WNT voor het VWS-domein. De brief van het CIBG past binnen die taak en had tot doel een vollediger beeld te krijgen van instellingen waarop de WNT van toepassing zou kunnen zijn met het oog op een jaarlijkse uitvraag van informatie. De brief was niet specifiek gericht op vrije beroepsbeoefenaren, maar in bredere zin op organisaties die zorg verlenen.
Ik vind het spijtig dat er vragen zijn gerezen naar aanleiding van de brief van het CIBG.
Er heeft overleg plaatsgevonden tussen de betrokken beroepsorganisaties om de brief te bespreken. Ook uit dit gesprek maak ik op dat er nog veel vragen zijn over de toepassing van de WNT op de aangeschreven zorgverleners. Ik streef ernaar deze vragen samen met de betrokken koepels te beantwoorden. Daarbij zullen ook vragen over de positie van solistische zorgverleners en vrije beroepsbeoefenaren en het door u aangehaalde commentaar van advocaten aan bod komen. Ik zal u een afschrift van die beantwoording doen toekomen.
