Inbreng behandelvoorbehoud
Ten eerste over de procedure van het behandelvoorbehoud. De minister moet de Kamer tijdig en periodiek goed informeren over de voortgang ten aanzien van de onderhandelingen, op alle punten waarop afspraken zijn gemaakt, elke keer weer.
Hij heeft hier tot nu toe geen goed trackrecord in opgebouwd, het is dat hij zo’n soepele commissie heeft in de commissie SZW, voorzitter. Aan de informatie-afspraken naar aanleiding van de onderhandelingen over de detacheringsrichtlijn heeft hij zich vaak onttrokken en de Kamer pas geïnformeerd na expliciete navraag. Ik hoop dat de minister hiervan heeft geleerd en naar de volgende Kamer zijn beste beentje voorzet.
Deze verordening gaat over coördinatie van sociale zekerheid. Op veel van de maatregelen is de regering kritisch en de VVD deelt die kritiek. Het zal de minister niet verbazen, als hij mijn bijdrage de laatste jaren heeft gevolgd dat de VVD in zijn nieuwe verkiezingsprogramma heeft staan dat zij de export van uitkeringen wil stoppen buiten Europa en voor zover dit niet kan binnen Europa, die onderhevig wil maken aan het woonlandbeginsel. Het uitgangspunt hierbij is dat de kinderbijslag bedoeld is ter tegemoetkoming van kosten van levensonderhoud in Nederland. Als die uitkeringen dan naar het buitenland gaan, moeten ze worden aangepast aan het prijsniveau van dat land. In dit kader zijn twee moties aangenomen in de Kamer. De motie Heerma uit 2013 vraagt om een discussie binnen Europa over een exportverbod van kinderbijslag. Een VVD/CDA motie van 3 maart 2016 vraagt om het hard maken voor het zo snel mogelijk toepassen van het woonlandbeginsel bij de export van kindregelingen in Europa. Beide moties zijn aangenomen en de minister behoort deze dan ook uit te voeren. Dit is zijn kans, zou ik zeggen! In Oostenrijk vind hij al zijn eerste bondgenoot.
Ik verzoek de minister als onderdeel van de informatie-afspraken over de gezinsbijlagen een beeld te geven hoeveel het onderhevig maken aan het woonlandbeginsel van de kinderbijslag binnen de EU zou opleveren en zich hard te maken om deze twee moties uit te voeren. Graag wordt de VVD geïnformeerd over de voortgang hierop. Hier hoor ik graag een toezegging van de minister op.
Het tweede punt betreft de werkloosheidsuitkeringen:
Het Kabinet vindt dat de ww een realistische weergave dient te zijn van het genoten salaris en de afgedragen premies. Daar is de VVD het mee eens. Wat wij als uitgangspunt hebben is dat mensen die zich voor het eerst vestigen in Nederland even lang moeten wachten tot ze een WW-uitkering kunnen aanvragen als mensen die al langer in Nederland wonen. Zij moeten zes maanden wachten, dus willen we dat EU-onderdanen ook zes maanden moeten wachten. Met vooruitziende blik heb ik hierover bij het debat over het akkoord van Marokko een motie ingediend, die is aangehouden, zodat de minister de motie kon betrekken bij wij hier het gesprek over konden voeren. In reactie op de motie gaf de minister aan dat hij het uitgangspunt van gelijktrekking van de termijn voor EU burgers en voor Nederlanders ondersteund. Daarom ben ik teleurgesteld dat ik dit in zijn standpuntbepaling niet terugvind. De minister zet in op het exporteren van drie maanden in plaats van zes maanden en legt zich neer bij de termijn van drie maanden waarna EU-migranten in Nederland WW kunnen aanvragen. Waarom zet hij niet op beiden in? Of allebei drie maanden of allebei zes maanden, vraag ik hem?
Graag zou ik over het onderdeel werkloosheidsverzekeringen ook een periodieke en gedetailleerde informatie over de onderhandelingen willen krijgen, die ook informatie geven over de financiële gevolgen voor Nederland van de verschillende voorliggende opties.
Relevante uitspraken van Europees Hof van Justitie: zaak Alimanovic van 15 september 2016 waarin gesteld is dat bijstand kan worden geweigerd als mensen korter dan een jaar hebben gewerkt. Hier wilde Rotterdam ook mee experimenteren. Hoe kan deze Hofuitspraak worden ingebracht in de onderhandelingen over deze verordening?
