Na jaren van soebatten en halve akkoorden met Marokko neemt de Tweede Kamer nu echt de stap om de export van uitkeringen richting Marokko aan banden te leggen.
Vanavond debatteert de Kamer met minister Asscher (Sociale Zaken) over het zogeheten socialezekerheidsverdrag waarin de export van uitkeringen is vastgelegd. Het kabinet wil toelagen als een nabestaandenuitkering, de kinderbijslag of een arbeidsongeschiktheidsuitkering aanpassen aan de levensstandaard van het land. Omdat die in Marokko lager is, zou dat betekenen dat de uitkering (voor nieuwe gevallen) een fors stuk omlaag kan.
Maar Marokko ligt dwars. Reden voor een rechtse Kamermeerderheid om nu de poot stijf te houden en de wet die opzegging van het verdrag regelt in behandeling te nemen. Als de Eerste Kamer vervolgens ook instemt, dan kan de opzegtermijn van zes maanden per 1 juli ingaan, zodat het verdrag daadwerkelijk op 1 januari volgend jaar is beëindigd.
„Als Marokko alsnog besluit snel te tekenen, dan is dat prima, maar we gaan niet nog meer eisen inwilligen”, aldus VVD-Kamerlid Schut. „Dit speelt al sinds 2011. Er is nu wel genoeg gewacht.” Ze stelt dat het minimumloon in Marokko op 250 euro per maand ligt. Een Nederlandse uitkering betekent zo dat iemand 1,5 keer modaal krijgt en dat kan niet de bedoeling zijn, benadrukt Schut. Ook het CDA vindt het nu wel mooi geweest met Marokko. „Het is zeer spijtig dat Marokko niet mee wil werken aan de modernisering van het verdrag. Daarmee is het opzeggen ervan het logische vervolg”, vindt CDA-Kamerlid Heerma.
Asscher houdt een muizengaatje open om alsnog tot een akkoord te komen met Marokko, maar het kabinet legt zich nu neer bij de wens van de Kamer om nu daadwerkelijk tot opzegging over te gaan. Vorig jaar dacht de PvdA-bewindsman meermaals met Marokko op overeenstemming af te koersen, maar eind vorig jaar kwamen de Marokkanen plots met aanvullende eisen. Zo zou Nederland onder meer ook uitkeringen moeten exporteren naar de Westelijke Sahara, een betwist gebied. Nederland kan daar volgens het kabinet onmogelijk aan voldoen, omdat de claims van Marokko op het gebied internationaal helemaal niet worden erkend.
Opzegging van het verdrag zal gevolgen hebben, waarschuwt Asscher in een brief aan de Kamer. Toen de opzeggingswet in 2014 een eerste keer werd ingediend, betitelde Marokko dat als een ’onvriendelijke daad’ en gaf het aan dat alles op alles zou worden gezet om de rechten van de Marokkaanse gemeenschap te beschermen. De regering in Rabat zegde onder andere medewerking op aan de terugkeer van illegale Marokkanen. Later, toen er weer werd onderhandeld, werd de belofte gedaan weer mee te werken, maar nog steeds is de samenwerking niet op niveau als voor indiening van de opzeggingswet.
