In lijn met het Europees subsidiariteitsbeginsel zijn sociale zaken primair een nationale aangelegenheid. Zij worden ook betaald uit nationale regelingen van belastingen en premies van burgers. Wat van belang is voor de VVD, is dat je binnen Europa als lidstaten veel van elkaar kan leren: wat doe je goed, wat doe je verkeerd.
Binnen het Europees Semester krijgen landen specifieke aanbevelingen tot hervormingen in sociale zekerheid. Zo heb ik, als rapporteur van het Europees Semester vanuit het nationale parlement, in gesprekken met Fransen het gehad over het verhogen van de pensioenleeftijd om de problemen van vergrijzing aan te pakken. Het is aan de Europese Unie om de noodzaak tot hervormingen aan te geven, maar niet de manier waarop. Wel om van elkaar te leren hoe je met hervormingsweerzin omgaat en hoe je sociale zaken nationaal goed kan organiseren.
Juncker’s social triple A
Het Youth Guarantee Initiative is een post-crisis instrument dat vanuit Europa wordt gepropageerd maar eigenlijk in Nederland op een soortgelijke manier al bestaat. In Nederland hebben we al het beleid dat je onder de 27 een baan hebt of een opleiding volgt, maar niet in de bijstand komt. Het is uiteraard goed als andere landen ook zulke zaken zouden regelen om jeugdwerkeloosheid te voorkomen.
Wij zijn voorstander van de versterking van de sociale dialoog. Maar het is belangrijk dat er geen onderscheid wordt gemaakt tussen de eurozone en de overige lidstaten: dan zet je die twee steeds verder uit elkaar. Tenzij het echt meerwaarde heeft, maar dat hebben we op sociaal gebied nog niet gezien.
Wij zijn tegen het idee dat sociale partners op Europees niveau afspraken kunnen maken die directe werking hebben in de verschillende lidstaten. Bij cao’s hebben we hier in Nederland goede ervaringen met maatwerk dat inspeelt op de nationale en/of sectorale situatie. Afspraken op Europees niveau gaan hier juist tegen in.
Het uitgangspunt is dat je de economie meer schokbestendig maakt. Europese voorstellen gaan echter vaak over bescherming van bestaande rechten waarbij in landen waar nog geen rechten als minimumloon, vergoeding bij zwangerschap of volledige uitbetaling bij verlof, deze voorzieningen worden opgetrokken naar het niveau van lidstaten die dat wel hebben. Dat betekent dat je een race to the top krijgt en arbeid duurder maakt. Je beschermt de mensen die nu werken, maar dat heeft als negatief gevolg dat het duurder wordt om iemand aan te nemen, waardoor er uiteindelijk meer werkeloosheid ontstaat. Dat gaat uiteindelijk ten koste van de interne Europese concurrentieverhoudingen en de Europese positie ten opzichte van andere economische machtsblokken, en tast zo het succes van de Europese markt aan.
Het maximale uit je economie halen
Bij crisis kunnen hervormingen en arbeidsmobiliteit een oplossing vormen, fiscale transfers naar andere lidstaten echter niet. Hervormingen zijn nodig om een level playing field te behouden en op lange termijn economisch concurrerend te blijven. Het functioneren van de interne markt kan worden verbeterd, bijvoorbeeld door de Europese vacaturebank EURES.
Hervormingen en arbeidsmobiliteit, geen fiscale transfers
Binnen het Europees Semester is het idee dat het maximale uit je eigen economie wordt gehaald. Terwijl wij al veel verder zijn met ons pensioenstelsel vergeleken met andere lidstaten wordt er gezegd dat de pensioenen bij ons moeten worden hervormd. De vergrijzing slaat bij ons eerder toe en we zitten hier ook met een intergenerationele kloof, dat jongeren betalen voor ouderen. Daar moet ons stelsel op inspelen. In andere lidstaten spelen weer andere situaties met andere uitdagingen, zoals een te lage pensioengerechtigde leeftijd, compleet door de overheid betaalde pensioenen of een 35-urige werkweek.
De Asscher agenda
Detachering valt binnen het vrije verkeer van diensten. Het is logisch dat als je als dienstenleverancier voor een bepaalde tijd in een ander land werkt, je zelf de secundaire arbeidsvoorwaarden bepaalt maar je werknemers wel voldoen aan nationale wet- en regelgeving, zoals het minimumloon. Veel werk dat Nederlandse werknemers niet graag willen doen, wordt nu door Oost-Europeanen gedaan. Kijk maar naar de aspergestekers die men eerst niet kon vinden. Zij maken de werkgelegenheid en dus de economie in Nederland en Europa groter. Van verdringing van werknemers is in Nederland geen sprake. Er zijn vele onderzoeken, zoals van de SER die dit hebben aangetoond. Arbeidsmobiliteit en dienstverlening elders uit Europa zijn aanvullend.
De bestaande voorstellen om de detacheringsrichtlijn te herzien verlagen de werkgelegenheid. De arbeidsmobiliteit geeft een natuurlijke druk op de lonen, omdat er mensen zijn die voor het minimumloon willen werken en niet voor het gemiddelde CAO-loon dat 30-40% hoger ligt. Meer mensen krijgen zo een baan en houden ook hun baan. Bij het idee het gemiddelde van cao’s uit te betalen aan iedereen, dus ook bij mensen van buiten Nederland die een tijdelijke klus doen, is niet stil gestaan bij wie het zou moeten betalen. In sommige sectoren zijn de marges voor ondernemers enorm klein. Een dergelijke verhoging van de loonkosten voor tijdelijke klussen doet hen de das om. En dat kost banen.
De VVD is als enige Nederlandse partij het eens met de getrokken gele kaart van 11 andere nationale parlementen tegen de herziening van de detacheringsrichtlijn. Het gaat hier niet alleen om Oost-Europese lidstaten, maar ook de Baltische staten en Denemarken. Voor de VVD gaat werk altijd boven inkomen. Het gaat erom dat wij ervoor kiezen om degene die werkloos is, een perspectief te bieden op een baan, in plaats van een bestaande werknemer meer te beschermen. Uiteindelijk hebben zo meer mensen werk en zijn we allemaal beter af.
Tegelijkertijd vinden we wel dat er beter moet worden gehandhaafd via de Handhavingsrichtlijn om uitbuiting, zwart werk en mensenhandel aan te pakken. Want iedere werkgever moet zich in Nederland aan de Nederlandse wet- en regelgeving houden, zoals het Nederlandse minimumloon en de arbeidstijdenwet. Daar zijn we voor!
Een sociale les uit de Brexit
In een motie in maart heb ik ervoor gezorgd dat de Nederlandse regering zich zou inzetten om het sociale component in het Brits-EU lidmaatschap pakket ook te krijgen als het zou komen tot een Brexit. Het pakket was onderhandeld door Cameron in februari voor het verzekeren van EU-lidmaatschap. Het ging bij Cameron niet zozeer om het tegengaan van arbeidsmigratie maar om het aanpakken van ongewenste effecten. Het is heel normaal dat het woonlandbeginsel wordt toegepast in de EU. Zo is het bijvoorbeeld logisch dat je kinderbijslag, die overal in Europa bestaat, aanpast aan het prijspeil van het land waar de kinderen verblijven. In het geval van het VK was dit veelal Polen. Nu er voor Brexit is gestemd en Cameron’s deal van tafel is, heeft de VVD ervoor gepleit om de invoering van het woonlandbeginsel alsnog in EU-regelgeving in te voeren.
