Regeringspartij VVD staat bepaald niet te springen om een herziening van de Europese Detacheringrichtlijn, die het principe van ‘gelijk loon voor gelijk werk op dezelfde werkplek’ dichterbij moet brengen. Dat bleek woensdag bij een debat in de Tweede Kamer.
Volgens de VVD gaat de aanpassing van de Detacheringrichtlijn ‘werk vernietigen’. Bedrijven die werknemers uit andere EU-lidstaten tijdelijk voor een klus willen inhuren, worden dan ook nog eens bedolven onder de administratieve lastendruk, aldus Kamerlid Anoushka Schut-Welkzijn.
Oneerlijke concurrentie
Ze wordt naar eigen zeggen ‘niet overtuigd’ door het standpunt van minister Lodewijk Asscher van Sociale Zaken dat het aanscherpen van de EU-richtlijn noodzakelijk is om de ‘oneerlijke concurrentie op arbeidsvoorwaarden’ een halt toe te roepen. Illegaliteit en uitbuiting kan de EU beter bestrijden door meer te handhaven, meent ze. ‘Dit schiet zijn doel voorbij.’
In de huidige Detacheringsrichtlijn uit 1996 staat dat bedrijven hun arbeidsmigranten minstens het minimumloon moeten betalen dat in een wet of een cao is vastgelegd. In de praktijk betekent dit dat Oost-Europese arbeidsmigranten vaak louter het minimumloon krijgen, terwijl hun Nederlandse collega’s wel recht hebben op een hogere cao-loonschaal, toeslagen en bijvoorbeeld een reiskostenvergoeding. Zij zijn daardoor veel duurder en worden de markt uitgeprijsd. Zeker omdat werkgevers voor de Oost-Europeanen geen Nederlandse pensioen- en sociale premies hoeven af te dragen bij tijdelijke werkzaamheden.
Verzet
Onder meer regeringspartij PvdA en de oppositiepartijen CDA, SP en D66 zijn daarom voorstander van een strengere Detacheringrichtlijn volgens het principe ‘gelijk loon voor gelijk werk’. Het kabinet heeft de afgelopen jaren meermalen in Brussel gepleit voor een herziening, maar stuitte lang op verzet. Inmiddels zijn echter ook Frankrijk, Duitsland, Zweden, België, Luxemburg en Oostenrijk om en heeft eurocommissaris Marianne Thyssen (Arbeidsmobiliteit) in maart hervormingsvoorstellen gepresenteerd. Het overleg hierover kan overigens nog wel even duren, mede omdat de Oost-Europese lidstaten niet blij zijn met de plannen. Zij zien die als een belemmering voor hun inwoners.
Niet ver genoeg
De Nederlandse vakbeweging en ook PvdA, SP en CDA vinden juist dat Thyssen niet ver genoeg gaat. Zo stelt de Europese Commissie voor de duur van detachering te begrenzen tot twee jaar. Maar volgens de tegenstanders is dat veel te lang. De Detacheringrichtlijn zou al niet meer van toepassing moeten zijn als een klus langer duurt dan een half jaar in plaats van twee jaar. Werkgevers moeten dan niet alleen meer hetzelfde loon voor hetzelfde werk betalen, maar ook nog eens Nederlandse sociale zekerheidspremies afdragen. Want de arbeidsmigranten vallen dan onder het Nederlandse arbeidsrecht. CDA en PvdA delen die mening, maar de SP wil dit al ‘vanaf dag nul’.
